Protection Of Personal Information Act (POPI) Consent Clause

I agree that my photograph:

• may be processed by Synthesis for any legitimate purpose as determined by Synthesis  
• can be grouped with others according to an algorithm into an image mosaic and will be used on social media
• may be kept by Synthesis and used for marketing, communications, remarketing and
• may be recorded, organised, collated, stored, updated, modified, retrieved, altered, consulted, used, disclosed, further processed,
• may be transmitted- including transmission to a third party in a foreign country, distributed or made available- also in another form, subjected to further processing, and
• it may be merged, linked, restricted, degraded, erased and/or destroyed.

I will ensure that any photograph of a child will be supplied to Synthesis only with the consent of a competent person to all of the provisions in this clause in respect of the minor’s photograph.

I agree to hold Synthesis blameless for any unintended data breach which may occur and result in the unauthorised processing of my/our personal information. I further agree that Synthesis shall not be liable for any claim of any nature, including claims under POPI, in respect of a data breach or unauthorised processing of my / our personal information, except if I can prove Synthesis acted with gross negligence or fraudulently.
